1. Acceptance of Terms

By downloading, installing, or using the PawCheck app or visiting pawcheck.in, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use PawCheck.

These Terms constitute a legally binding agreement between you and Canine Products ("we", "us", "our"), a business based in Mumbai, India.

2. Eligibility

You must be at least 18 years of age to use PawCheck independently. If you are between 13 and 17 years of age, you may only use PawCheck with the verifiable consent of a parent or legal guardian, who agrees to these Terms on your behalf.

PawCheck is currently available to users in India only. By using PawCheck, you represent that you are accessing the service from within India.

3. The PawCheck Service

PawCheck provides AI-powered pet wellness screening for dogs and cats. The service allows you to:

• Photograph your pet's eyes, skin, ears, teeth, stool, or wound and receive an AI-generated severity assessment (Normal / Monitor / Urgent).
• Store your pet's health records, vaccination history, and scan history.
• Find nearby veterinary clinics.
• Browse over-the-counter pet health products.
• Subscribe to PawCheck Pro for unlimited scans and additional features.

3.1 Nature of AI Results

All scan results are generated by artificial intelligence (Google Gemini 2.5 Flash and/or PawCheck's on-device TFLite models). AI results:

• Are probabilistic and carry inherent uncertainty, reflected in the confidence score shown with every result.
• Are intended to help you decide whether to seek veterinary care — not to replace it.
• May be incorrect. PawCheck is not liable for any harm arising from reliance on AI-generated results.
• Are labelled with a severity tier (Normal / Monitor / Urgent) as a general guide only.

3.2 No Veterinary Relationship

Use of PawCheck does not create a veterinarian-patient relationship. PawCheck's AI is not a licensed veterinarian and cannot provide veterinary advice. For any health concern about your pet, consult a qualified veterinarian.

4. Account Registration

To use PawCheck you must register an account using your Indian mobile number (+91). You are responsible for:

• Providing accurate information during registration.
• Keeping your account secure. Do not share your OTP or session with anyone else.
• All activity that occurs under your account.

We reserve the right to terminate accounts that violate these Terms or are suspected of fraudulent or abusive activity.

5. Free Tier and Scan Limits

Free accounts receive a limited number of scans per month (currently 5 health scans). Scan limits are enforced server-side. Additional scans may be earned by watching a rewarded advertisement (up to 2 bonus scans per month).

Scan limits may change at our discretion. We will notify users of significant changes via the app.

6. Pro Subscription

6.1 What Pro Includes

• Unlimited health scans per month.
• No advertisements.
• Pet health card PDF export.
• Access to detailed SOAP-format scan notes (For Vet tab).

6.2 Pricing and Billing

PawCheck Pro is currently priced at ₹99 per month. Billing is handled exclusively through Google Play's in-app billing system. By subscribing, you agree to Google Play's Terms of Service in addition to these Terms. Your subscription renews automatically each month unless cancelled.

6.3 Cancellation and Refunds

You may cancel your Pro subscription at any time via Google Play → Subscriptions. Upon cancellation, Pro access continues until the end of the current billing period. Refunds are governed by Google Play's refund policy.

6.4 Restore Purchases

If you reinstall PawCheck or change devices, use the "Restore Purchases" option (available in Settings → Account and on the subscription screen) to reinstate your Pro subscription.

7. User Content

When you submit pet photos and data to PawCheck, you grant Canine Products a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the PawCheck service to you.

You represent that:

• The photos you upload are of your own pet or a pet in your lawful care.
• The photos do not contain images of people, private property, or any content that violates applicable law.
• You have the right to submit the content.

If you have opted in to the AI training programme (Settings → Privacy), you additionally grant us the right to use anonymised scan images to train and improve PawCheck's AI models. This opt-in can be withdrawn at any time.

8. Prohibited Uses

You must not:

• Use PawCheck to submit photos of humans or to attempt to obtain medical advice for humans.
• Attempt to reverse-engineer, decompile, or extract PawCheck's AI models or source code.
• Use automated tools, scripts, or bots to submit scans or access PawCheck's API.
• Attempt to circumvent scan limits, subscription checks, or any server-side enforcement.
• Upload content that is illegal, offensive, defamatory, or violates any third party's rights.
• Use PawCheck for any commercial purpose without our express written consent.
• Misrepresent PawCheck's capabilities — including claiming it provides veterinary diagnoses.

9. Marketplace and Affiliate Links

PawCheck's marketplace displays over-the-counter pet health products from third-party brands. All products sold through the marketplace are subject to the seller's own terms of sale and return policies.

PawCheck earns affiliate commissions on purchases made through product links in the app. This is disclosed within the app wherever affiliate links appear. Affiliate relationships do not influence the AI scan results shown to you.

PawCheck does not sell prescription medicines or veterinary drugs. All products in the marketplace are OTC (over-the-counter) only.

10. Sponsored Vet Listings

Some veterinary clinic listings in the vet locator are sponsored (paid listings). Sponsored listings are clearly marked as "Sponsored" within the app, as required by ASCI (Advertising Standards Council of India) guidelines. Sponsorship does not imply endorsement by PawCheck of that clinic's services.

11. Intellectual Property

All content on pawcheck.in and in the PawCheck app — including the app design, AI models, brand assets, blog content, and condition pages — is the intellectual property of Canine Products and is protected by applicable copyright and intellectual property law.

You may not reproduce, distribute, or create derivative works from PawCheck's content without our express written permission.

12. Disclaimer of Warranties

PawCheck is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The AI scan results will be accurate, complete, or suitable for any particular purpose.
• The service will be uninterrupted, error-free, or secure at all times.
• Any specific condition will be detected or correctly identified.

The AI-generated severity assessment (Normal / Monitor / Urgent) is a triage indicator only and should not be the sole basis for any veterinary decision.

13. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Canine Products and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of PawCheck, including but not limited to:

• Reliance on AI-generated scan results.
• Delay in seeking veterinary care.
• Loss of data.
• Interruption of service.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Canine Products from any claim, liability, damage, or expense (including reasonable legal fees) arising from your violation of these Terms or misuse of the PawCheck service.

15. Privacy

Your use of PawCheck is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using PawCheck, you consent to the data practices described in the Privacy Policy.

16. Modifications to the Service and Terms

We reserve the right to modify or discontinue PawCheck (or any part of it) at any time with reasonable notice. We may update these Terms from time to time. When we make a material change, we will notify you via the app. Continued use of PawCheck after such notice constitutes acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Before initiating formal legal proceedings, both parties agree to attempt good-faith resolution by contacting support@pawcheck.in.
